Заява МЗС України щодо загрози незаконного усиновлення українських дітей громадянами держави-агресора
У ході триваючої повномасштабної агресії Російської Федерації проти України російські окупанти продовжують, в порушення міжнародного права, вдаватися до неприпустимих дій – незаконного та насильницького переміщення громадян України, зокрема дітей, у т.ч. дітей-сирот, дітей, позбавлених батьківського піклування, а також дітей, батьки яких загинули внаслідок військової агресії Росії, через державний кордони нашої держави на територію Росії.
Кричущою є загроза незаконного усиновлення українських дітей російськими громадянами без дотримання всіх необхідних процедур, визначених законодавством України.
У цьому контексті особливу стурбованість викликає інформація про намір міносвіти РФ підписати з російськими окупаційними адміністраціями у Донецькій та Луганській областях - т.зв. «Л/ДНР» - «угоди», які б дозволили передавати незаконно депортованих з території України дітей-сиріт в російські сім’ї.
Відповідно до Конвенції ООН про права дитини, держави, що є сторонами цього міжнародного договору, у т.ч. Росія й Україна, зобов'язані вживати заходів задля боротьби з незаконним переміщенням і неповерненням дітей із-за кордону.
Спроби Кремля надати своїм злочинним діям на території України «законних» підстав є цинічним нехтуванням засадничими правилами і звичаями ведення війни та загальновизнаними правами людини.
Фактично Росія в порушення міжнародного гуманітарного права та елементарних стандартів людяності займається організованим на державному рівні викраденням дітей і руйнуванням майбутнього української нації.
Такі дії російських окупантів можуть кваліфікуватися як кіднепінг (викрадення) та вимагають рішучої реакції міжнародної спільноти, насамперед, відповідних міжнародних організації.
Міністерство закордонних справ України звертається до Управління Верховного комісара ООН у справах біженців, Міжнародного Комітету Червоного Хреста, ЮНІСЕФ, Управління Верховного комісара ООН з прав людини, Спеціальних представників Генерального секретаря ООН з питань дітей у збройних конфліктів та з питань насильства щодо дітей вжити невідкладних заходів задля повернення українських дітей на територію нашої держави.
Declaração do MNE da Ucrânia sobre a ameaça de adoção ilegal de crianças ucranianas por cidadãos da Federação Russa.
No decurso da contínua agressão em larga escala da Federação Russa contra a Ucrânia, os ocupantes russos continuam a violar as normas do Direito Internacional e recorrem a ações inaceitáveis - o deslocamento ilegal e forçado de cidadãos ucranianos, incluindo crianças, entre eles órfãos, crianças privadas de cuidados parentais, bem como crianças cujos pais morreram como resultado da agressão militar da Rússia, através das fronteiras do nosso Estado até ao território da Rússia.
Uma ameaça flagrante de adoção ilegal de crianças ucranianas por cidadãos russos, sem que se observem todos os procedimentos necessários determinados pela legislação da Ucrânia.
Neste contexto, informações sobre a intenção do Ministério da Educação da Federação Russa de assinar “acordos” com as administrações de ocupação russas nas regiões de Donetsk e Luhansk que permitiriam a transferência de órfãos ilegalmente deportados do território da Ucrânia para famílias russas chama particularmente à atenção neste contexto.
De acordo com a Convenção das Nações Unidas sobre os Direitos da Criança, os Estados que fazem parte deste tratado internacional, incluindo a Rússia e a Ucrânia, são obrigados a tomar medidas para combater o movimento ilegal e o não retorno de crianças do exterior.
As tentativas do Kremlin de fornecer fundamentos “legítimos” para as suas ações criminosas no território da Ucrânia são um desrespeito cínico pelas leis e costumes fundamentais da guerra e pelos direitos humanos universalmente reconhecidos.
De facto, a Rússia está envolvida no sequestro de crianças organizado pelo estado-ocupante e na destruição do futuro da nação ucraniana, violando o direito internacional humanitário e os padrões básicos de humanidade.
Tais ações dos ocupantes russos podem ser qualificadas como rapto e exigem uma reação decisiva da Comunidade Internacional, principalmente das organizações internacionais relevantes.
O Ministério dos Negócios Estrangeiros da Ucrânia apela ao Gabinete do Alto Comissariado das Nações Unidas para os Refugiados, ao Comité Internacional da Cruz Vermelha, à UNICEF, ao Gabinete do Alto Comissariado das Nações Unidas para os Direitos Humanos, ao Gabinete do Representante Especial do Secretário-Geral para Crianças e Conflitos Armados e ao Gabinete do Representante Especial do Secretário-Geral sobre Violência contra Crianças a aceitar medidas urgentes para o retorno das crianças ucranianas ao território do nosso Estado.
Statement by the MFA of Ukraine on the threat of illegal adoption of Ukrainian children by citizens of the Russian Federation
In the course of the ongoing full-scale aggression of the Russian Federation against Ukraine, the Russian occupiers continue to violate the norms of international law and resort to unacceptable actions - the illegal and forced displacement of Ukrainian citizens, including children, among them orphans, children deprived of parental care, as well as children whose parents died as a result of Russia's military aggression, across the state borders of our State to the territory of Russia.
A blatant threat of illegal adoption of Ukrainian children by Russian citizens without observing all the necessary procedures determined by the legislation of Ukraine.
In this context, information about the intention of the Ministry of Education of the Russian Federation to sign “agreements” with the Russian occupation administrations in the Donetsk and Luhansk regions that would allow the transfer of orphans illegally deported from the territory of Ukraine to Russian families calls the particular concern in this context.
According to the UN Convention on the Rights of the Child, the states that are parties to this international treaty, including Russia and Ukraine are obliged to take measures to combat the illegal movement and non-return of children from abroad.
The Kremlin’s attempts to provide “legitimate” grounds for its criminal actions on the territory of Ukraine are a cynical disregard for the fundamental laws and customs of warfare and universally recognized human rights.
In fact, in violation of international humanitarian law and basic standards of humanness, Russia is engaged in state-organised kidnapping of children and destruction of the future of the Ukrainian nation.
Such actions of the Russian occupiers can be qualified as kidnapping and require a decisive reaction from the international community, primarily from the relevant international organizations.
The Ministry of Foreign Affairs of Ukraine appeals to the Office of the United Nations High Commissioner for Refugees, the International Committee of the Red Cross, UNICEF, the Office of the United Nations High Commissioner for Human Rights, the Office of the Special Representative of the Secretary-General for Children and Armed Conflict and the Office of the Special Representative of the Secretary-General on Violence against Children to accept urgent measures for the return of Ukrainian children to the territory of our State.
